The problem
A trademark complaint doesn't come with a warning. When a rights owner reports a listing, Etsy takes it down, and repeated reports can put the whole shop at risk. The words that cause it often don't look like brand names: an everyday word like onesie, a slogan like Boy Mom printed on a shirt, a character name tucked into tag eleven. Searching the USPTO database one word at a time, for every listing, is slow, and it still won't show you which of your words are the risky ones.
Example check: the flagged word, why it was flagged, and the registration behind it.
What you get
Every risky word, flagged in context.
The title, description and tags are read together, so a brand name in your last tag is caught as easily as one in the title. Each flag says why it was raised and how serious it is.
The USPTO record behind the flag.
Who holds the trademark, the registration number, the classes of goods it covers and a link to the official record, right next to the word.
Words that don't look like brands.
Genericized trademarks like onesie, koozie and Popsicle, and trademarked slogans, are checked too, not just company names. See words that get Etsy listings removed.
A safer way to say it.
Each flag comes with how to fix it, and the check suggests a rewrite with the flagged words taken out, so you can check an Etsy listing for trademarks and fix it in one pass.
A trademark checker built on registrations, not guesses
Every flag has a source you can check. Words are matched against our trademark list and Etsy's own rules, and the record on the card is the registration itself: holder, number, status where we have it, and the class of goods it covers. A brand mentioned only to describe what your item is, or what it fits, is marked as a warning rather than a violation, so you can tell a word to remove from a word to look at.
How it works
- Paste the listing title. Add the tags and description if you have them; the more of the listing you paste, the more the check can catch.
- Press Check for trademarks. The result opens right here on the page.
- Read each flag, open the USPTO record, and copy the safer wording into Etsy.
Same word, different risk: why the class matters
A trademark is registered for specific goods, grouped into numbered classes: class 25 is clothing, class 21 is mugs and kitchenware, class 16 is paper goods and prints. The same word can be owned by one company for drinks and by nobody for jewelry. That's why the record on each flag shows its classes. Compare them with what you sell before you decide what to change, and see how to check a word against the USPTO database if you want to look further yourself.
After the check
Before you name a new product after a brand, look it up in the Etsy trademark brand directory, which lists the brands sellers get reported for most, with the record and safer wording for each. To check every listing in your shop, use the Listing Optimizer, which runs the same check and rewrites the title, tags and description for search.
If a listing has already been removed, the removal notice reader tells you what kind of removal it is and how long you have to reply, and the appeal letter tool writes the reply.
FAQ
How many listings can I check for free?
2 a day without an account, shared with the free check on our home page. A free account adds 20 credits a month, and each listing costs 1 credit. No card needed.
Where does the USPTO record come from?
From the USPTO register. Without an account, the check shows the records we already have on file, which include the brands in our Etsy trademark brand directory; a word we haven't looked up yet is still flagged, just without the record. With a free account, every flagged word is looked up on the register as you check.
Does it check tags as well as the title?
Yes. The title, description and up to 13 tags are checked together, the same way Etsy shows them as one listing.
Is every flagged word a problem?
No. A registration means someone owns the word for certain goods. A brand used as the name of your product is the serious kind; a brand mentioned to describe what your item is or what it fits is marked as a warning, and the class on the record shows what goods the registration covers.
Can I check my shop name?
Yes. Paste the shop name into the title box and check it like a listing.
How is this different from searching the USPTO website?
The USPTO search tells you whether one word is registered. This reads your whole listing, picks out the words that put it at risk, including slogans and genericized trademarks, and shows the record next to each one. To look a word up by hand, see how to check a word against the USPTO database.
Can I check my whole shop at once?
Yes, with a free account. Import the CSV from Etsy Shop Manager or connect your shop, and the Listing Optimizer checks every listing in one go, 1 credit per listing.
